1. Booking & Payment

A non-refundable retainer of 20% is required to secure your session date. No photos will be delivered until the full balance is paid.

This retainer guarantees the photographer’s availability and covers administrative work and the loss of potential bookings for the reserved time.

By paying this retainer, the client understands and agrees that:

-The retainer is not a deposit toward services rendered; it is a fee for reserving the photographer’s time and date.

-The retainer will not be refunded under any circumstances, including client cancellation, rescheduling, or no-show—unless

the photographer cancels the session or is otherwise unable to fulfill the agreement.

-The retainer will be applied toward the total session cost, with the remaining balance due.

-In the event of a reschedule due to illness, emergency, or weather,

the retainer may be transferred to a new date at the photographer’s discretion, provided that adequate notice is given and availability allows.

2. Cancellation & Rescheduling

Client-Initiated Cancellation: Cancellations made more than 3 days in advance may be rescheduled once without penalty.

Photographer-Initiated Cancellation: If the photographer must cancel due to emergency, illness, or other unforeseen circumstances,

the client may choose to reschedule or receive a full refund, including the retainer.

3. Turnaround Time

Standard turnaround time for portrait session galleries is 2 weeks.

Weddings and events may take up to 6 weeks or longer, depending on workload.

Rush editing is available for an additional fee.

4. Delivery of Images

Final edited images will be delivered via a private online gallery.

RAW or unedited files will not be provided under any circumstances.

5. Travel Fees

Sessions held outside a 25-mile radius of Martinsburg, WV will incur a travel fee of $0.70 per mile, round trip.

6. Model Release

By booking a session, you grant the photographer the right to use images for portfolio, website, social media, and promotional purposes.

That said, I do seek client permission before posting any photos from your session, and I fully respect your privacy if you prefer not to have your images shared publicly.

7. Copyright & Usage

The photographer retains full copyright of all images.

Clients receive a limited, non-commercial license to print and share images for personal use only.

Commercial use (including business marketing, publications, etc.) requires a separate licensing agreement and may incur additional fees.

Clients are welcome to share their final images on social media for personal use.

Please tag or credit the photographer when posting (@youforiaphotography). This helps support small businesses and is greatly appreciated.

8. Liability Limitation

The photographer is not liable for any injuries sustained during the session or for any loss/damage to personal property.

In the rare event of equipment failure, data loss, or other unforeseen circumstances preventing delivery of final images, the photographer’s liability is limited to the return of all payments received.

In the unlikely event of memory card failure, camera malfunction, file corruption, or accidental data loss that results in the total or partial loss of images,

the photographer’s liability is limited to the return of all payments received, including any retainer.

The photographer uses professional-grade equipment and regularly backs up files to minimize the risk of data loss. However, technology failures—though rare—can still occur.

9. Client Cooperation

Clients agree to arrive on time, follow reasonable guidance during the session and ensure all participants are willing and cooperative.

Lack of cooperation may impact image quality. The photographer reserves the right to end the session early if behavior disrupts the creative process or prevents successful completion of the shoot. Late arrivals may result in a shortened session or a need to reschedule. If the photographer is able to accommodate a late arrival, an additional fee may apply.

10. Backup & Storage

Edited images will be delivered via digital download and remain available for 30 days from the delivery date.

It is the client’s sole responsibility to download and back up all files during this period.

After 30 days, image availability is not guaranteed. If archived images can be retrieved, a retrieval fee will apply.

The photographer is not responsible for loss of images due to failure to download or back up files.

11. Editing

All images are edited in the photographer’s signature style.

By booking a session, you confirm that you are familiar with and accept this style.

Clients are not to apply any additional edits to photos under any circumstances.

I do not offer body slimming or unrealistic edits.

Only temporary or minor blemishes (such as scratches or breakouts) may be removed: things that would typically disappear within about two weeks.

Self-love is deeply important to me, and I will not alter your appearance in ways that reinforce unrealistic beauty standards.

You are beautiful exactly as you are, and this session is meant to celebrate that truth.
